Electricity Generation License (Wind - Non FiT Based)

Energy generating, transmitting or distributing projects including those under the FiT with a capacity above 3 MW must obtain an Electricity Generation License from the Energy Regulatory Commission (ERC). Projects with a capacity under 1 MW do not need an ERC clearance and those between 1 MW and 3 MW must obtain an Electricity Permit from ERC, which is a streamlined license. The license is open-ended and must not be renewed. The applicant has to give a notice of application to the Local Government, to ERC and publish the intention of the project in a newspaper at least 15 days prior to submission of the application.


  • Purpose: Compliance with the FiT Policy
  • Application Fee: Ksh. 10,000 (application fee),
  • Clearance Fee: Kshs. 2,000-20,000 per MW installed/transferred, annual fee Kshs. 1000-10,000 per MW installed/transferred
  • Maximum Processing Time: 90 days
  • Validity: Dependant on Technology type and PPA contract typically(20-25 years)
  • Clearance Type: License
  • Legal Basis: Energy Act 2006 and Energy (Electricity Licensing) Regulations 2010
  • Annual Renewal: None,but an annual fee and fees for modification or transfer of licence of Ksh 5000/MW of installed capacity is charged.
